Warringah Council is currently preparing a Draft Warringah Development Control Plan (DCP) in accordance with the NSW Planning Reform requirements and Environmental Planning and Assessment legislation.
The Draft DCP shall complement the new Draft Warringah Local Environmental Plan (LEP). The Draft DCP will provide additional detail on Council’s planning requirements for those submitting or processing development applications in the future.
The Draft DCP is currently undergoing an internal review and editing process by Council Staff. Following this it will be professionally formatted to help create a user friendly document for Council and the community.
A Council report on the Draft DCP shall be presented at a Council meeting for the purpose of endorsement to publicly exhibit the draft plan, once its content and format have been finalised.

1. What is a Development Control Plan (DCP)?
A DCP is a plan that outlines the controls that apply to a particular zone and/or to a type of development. Its content and format are flexible, and it can consist of a combination of text, diagrams, maps and illustrations. A DCP provides greater detail and supplements a Local Environmental Plan (LEP). To gain the full planning picture for an area, the plans need to be read together.
LEP’s and DCP’s are made in accordance with the NSW Environmental Planning and Assessment legislation.

2. What land does the Draft DCP apply to?
The Draft DCP applies to all land located within the Warringah Council Local Government Area (LGA).
3. Why is Council preparing a new Draft DCP?
During 2005/2006 the NSW Government introduced a range of reforms to the planning system; one of which requires all Councils to prepare a new comprehensive Local Environmental Plan (LEP) for their areas. Council’s are required to prepare their LEP’s in accordance with a standard LEP template which took effect on 31 March 2006. Warringah Council has been granted a three year timeframe in which to complete its new comprehensive LEP.
Council has commenced work on translating its current planning provisions that are contained within Warringah Local Environmental Plan 2000 (WLEP 2000) into a new Warringah LEP in the standard format. This format is largely fixed. Currently, the WLEP 2000 attempts to incorporate all planning provisions that apply to each parcel of land into a single document. The NSW Government’s standard LEP template moves away from this model.
The Draft DCP will ensure that all relevant planning provisions contained in the WLEP 2000 are translated into the new planning system.
4. When will the Draft DCP be available?
Warringah Council is required to have a new LEP based on the Standard Instrument ready for gazettal by the Minister for Planning within a three year time period ending 31 March 2009. Council is therefore working toward having the Draft LEP document and maps ready for statutory public exhibition by the end of 2008.
As the Draft DCP shall serve to provide greater detail, refine and supplement the content of the new LEP, it is preferable that the DCP be gazetted within a similar timeframe as the new LEP. Therefore, the Draft DCP is also anticipated to be ready for statutory public exhibition by the end of 2008. Exact timing can not however be confirmed at this stage.
From March 2006, Council’s Strategic Planning officers have been preparing the new LEP related documents including the Draft DCP.
The Draft DCP is currently undergoing an internal review and editing process by Council Staff. When it’s content is finalised, the Draft DCP will be professionally formatted to help make it a user friendly document for Council and the community. In addition, Council’s web site will be updated to help guide the community through the new planning system.
6. How do I plan for future development of my property?
The existing WLEP 2000 and its planning and development controls will continue to apply until the Minister gazettes the new LEP. However, once the Draft LEP has been placed on public exhibition, it does have some status under the planning legislation. Both documents will need to be considered by applicants and Council assessing applications during this interim period.
The Draft DCP has no legal status until after the public exhibition and adoption by Council. The date of adoption of the Draft DCP will be formally announced in the local press prior to it’s enforcement.
7. How will we respond to your emails, letters and input?
Submissions received during the public exhibition period will be acknowledged with a standard letter or email. A detailed response to submissions will be reported to Council after the public exhibition and prior to the DCP’s adoption.
