LEP 2011 - Deferred Land

The Warringah Local Environmental Plan 2011 (LEP 2011) came into effect on Friday 9 December 2011.
The LEP 2011 is available for viewing and downloading from the NSW Government’s legislation website
Deferred Land
In approving LEP 2011, the Minister for Planning and Infrastructure decided to defer certain land from the new LEP. The deferred land is currently within the B2 Oxford Falls Valley and C8 Belrose North localities under LEP 2000 and will remain under the provisions of LEP 2000.
The land that the Minister decided to defer from LEP 2011 was proposed by Council to be zoned E3 Environmental Management.
The deferred land is identified on the LEP 2011 – Land Application Map as “Deferred matter”
This means Council is running two Local Environmental Plans, LEP 2000 and LEP 2011, until the State Government resolves the issues involved in the deferral of land.
The new DCP controls do not apply to the deferred land.
At this time, there are no DCP controls governing deferred land as DCP like controls remain in LEP 2000.
