Application Determination Panel Charter View

The Panel

Application Determination Panel was set up in June 2005.

The Panel consists of three (3) persons and meetings are twice a month on Thursdays generally and the meeting is not open to the public.

Purpose

To make Development Assessment determinations on applications that have unresolved submissions and are not within the responsibility of the Warringah Development Assessment Panel.

Objectives

To provide increased transparency in the Development Application  (DA) assessment process.

To achieve development outcomes consistent with the Warringah Local Environmental Plan 2000 and any relevant DCP.

To ensure the achievement of proper processing of DAs consistent with adopted procedures.

Outcomes

  • Consistent outcomes on development matters consistent with the intent of the Warringah Local Environmental Plan.
  • Reduction in the number and cost of appeals to the Land and Environment Court.
  • Quality development outcomes.
  • Learning and development for staff.

Functions

To assess Development Applications referred to it and make determinations for the following:

  • All applications that are not required to be referred to WDAP/WDRP or JRPP and where there are more than four (4) relevant objections

relevant objection means:

Written submission in response to Council’s notification/exhibition of a development application, which in the opinion of the Group Manager Development and Compliance Services raises specific issues for the refusal of the application or would otherwise require significant changes or restrictions to the proposed development.

  • Any other application at the discretion of the Deputy General Manager Strategic and Development Services or Group Manager Development and Compliance Services. 
  • In considering applications, ADP is to take into account, but not be limited to, the following:
    • Independent mediation or negotiation reports.
    • Relevant statutory environmental planning instruments specifically WLEP, DCP and/or Council policies (Design Guidelines, Notification Policy, Land & Environment Court planning Principles and the like).
    • Compliance with statutory provision, particularly the Local Government Act 1993, and the Environmental Planning and Assessment Act 1979. 
  • The Panel may defer items for additional information / clarification / Inspections.
